ARTICLE 1: JURISDICTION

This policy shall be deemed to have been issued in the Republic of Iraq and is to be governed by the laws of this Republic and the Iraqi Courts shall have jurisdiction in any dispute arising hereunder.

ARTICLE 2: OBJECT AND EXTENT OF THE INSURANCE

The Company will pay the benefits set out in the schedule herein if at any time during the period of this insurance the insured shall
A.&nbsp; Sustain a bodily injury resulting from an accident as defined herewith and which shall within twelve calendar months from the date of the accident causing such injury occasion Death and/ or Disablement.
B.&nbsp; provides a daily hospital cash in fixed amount if the insured is hospitalized due to accident or illness as defined herewith

ARTICLE 3: Accidental Death & Permanent Total Disablement due to Accident

The Company shall not be required to pay compensation, under more than one of the benefits provided in the schedule in respect of the consequences of one accident, within the limit stated in the Schedule, in addition to any other compensation.

ARTICLE 3: ACCIDENTAL DEATH & PERMANENT TOTAL DISABLEMENT DUE TO ACCIDENT

ARTICLE 4: HOSPITAL CASH BENEFIT RIDER

The Company will pay the compensation provided in the Schedule herein in the case of an accident occasioning temporary total disablement, which entirely prevents the insured from attending to his business or occupation.
Hospital Days Benefit entails in case of in-patient stay in a hospital as a result of an accident or sickness.
• The deductible applicable is 2 days for both accident and sickness
• The deductible is applicable up to 2 entries per year with a total maximum stay of 15 days
• For severe diseases (Cancer, heart surgery and COPD/related pulmonary disease), no benefits will be payable within 6 months period after the enrolment date of the subscriber.
The Company will pay this compensation so long as such total stay in a hospital continues but not exceeding 15 days altogether for any single accident or sickness.
However, there is no obligation on the Company to pay this compensation until the total amount has been ascertained and agreed. If nevertheless payments on account are made by the company in this connection and the Company subsequently becomes liable to pay an indemnity under any other benefit of the Schedule the amount already paid in respect of the compensation shall be deducted here from.

ARTICLE 5:

The total sum payable under this policy in respect of any one or more claims in respect of any insured shall not exceed in all in any one period of insurance the largest benefit applicable in respect of that Insured.

ARTICLE 6:

All benefits will be payable to the insured if living, otherwise to his nominated beneficiaries.

ARTICLE 7: DURATION OF POLICY, RENEWAL, AUTOMATIC TERMINATION.

The policy is written for the period stipulated in the Schedule. At the expiry date, it will be renewed from year to year at the request of the Assured.
Failing payment at the renewal date of the premium the company shall proceed to terminate this policy in accordance with the law in force.
If, in the event of war or "Force Majeure" the company has no means of notifying the Insured of its intention to cancel the policy as from the expiry date stated in the Schedule, then this policy shall be deemed to have been terminated automatically at the said expiry date.
In case of cancellation of the subscription before the 12 months policy duration goes to end, by a policyholder having a claim, no premium refund shall be granted.
In case of no claims, the premium refund shall be based on the remaining months, e.g. if a policyholder wants to cancel in the middle of the first month of the policy, the refund shall be only for 11 months and not for 11 months and a half.
Should the Contract between the Company and Zain Telecom be renewed for any further 12 months period, then Zain Telecom Subscribers’ Individual Policies renewed during the corresponding Contract Period shall be also covered under the Contract.
Termination of cover:
• death/disability of the insured
• on cancellation by the insured (including non-renewal of his subscription)
• if premiums have not been paid by the insured
• at the end of the policy term (12 months as per inception date)
• on reaching the end age of cover stated in the policy, subject to the Maximum Exit Age specified hereunder.
Age limits:
Minimum Entry Age: 18 years age last
Maximum Entry Age: 64 years age last
Maximum Exit Age: 65 years age last

ARTICLE 8: OBLIGATIONS OF THE INSURED DURING THE CURRENCY OF THE POLICY.

In the course of the policy the Insured must declare to the company by registered letter any change of his profession or occupation when the new profession or occupation carries greater risks than declared at the commencement of the Insurance.
Such declaration must be made within 15 days from the time the change took place and the Company has the right either to cancel the policy or to propose a new rate of premium.
Failing compliance with the provisions of this article, all claims arising from the new occupation or profession shall be forfeited.

ARTICLE 9: ELECTION OF DOMICILE

Any communication made by the company to the insured at the address shown in the Schedule shall be held binding upon him
Any change in the elected address of the insured should be notified to the company by registered letter.

ARTICLE 10: REPORTING AND SETTLEMENT OF LOSSES

In case of any accident likely to give rise to a claim, notice must be given to the Company within eight days counting from the time when, the insured or his legal representatives or beneficiary (ies) have knowledge of it (except for fortuitous circumstances or in the case of "Force Majeure").
In the event of non-fatal injury the Insured shall from time to time when required by the Company submit himself to be examined by a medical referee appointed by the Company and in the event of the death of the Insured the Company shall have the right to require a post-mortem examination.

Article 11: BENEFITS & DEFINITIONS

The main benefit of this cover is “Accidental Death” (ADB).
The additional benefits of this cover are “Accidental Permanent &amp; Total Disability (PTD accident)” &amp; “Hospital Cash Benefit Rider”
Definitions for covered conditions
• Accidental Death Benefit:
The covered amount is payable on death due to accident.
• Permanent and Total Disability (PTD) (Accident) any occupation:
The covered amount is payable on permanent and total disablement due to accident if the policyholder is totally unable by reason of accident to follow his own occupation or any other occupation for remuneration. There is a deferment period of 6 months.

Article 12: Hospital Cash Benefit Rider Terms and Conditions

Article 12: HOSPITAL CASH BENEFIT RIDER TERMS AND CONDITIONS

This policy witnesses that Dar Al Aman Insurance Company (herein called "the Company"), subject to the Terms, Provisions, Exclusions and Conditions contained herein or endorsed hereon, agrees to pay the benefits set out in the SCHEDULE hereof in the event of bodily injury sustained by the Insured prior to this 65th birthday and before the expiry date stated herein, and caused solely and directly by accidental, violent and visible means.

This policy, issued in consideration of the proposal thereof, shall take effect on the inception date as stated in the Schedule provided the corresponding premium is duly paid.

The provisions, exclusions and benefits set forth, and the proposal referred to in the Schedule together with all statements made and signed by the Insured shall form the basis of the contract.
